AI Compliance, Data Protection, and Compliance Guidelines for the LeadGeneratorX Partner Program

These guidelines (“Guidelines”) outline the responsibilities and obligations of LeadGeneratorX and its partners (“Partners”) regarding the use of AI, data protection, and compliance with applicable laws and regulations. By participating in the LeadGeneratorX Partner Program (“Program”), you agree to adhere to these Guidelines.


1. AI Compliance

1.1. Responsible Use of AI

1.1.1. Transparency:
Partners must clearly disclose the use of AI in marketing, content creation, and customer interactions when required by applicable laws or ethical standards.
1.1.2. Accuracy:
Ensure that AI-generated content, such as marketing copy or customer communications, is accurate, ethical, and does not mislead or deceive customers.
1.1.3. Avoidance of Harm:
AI tools must not be used to create or distribute harmful, discriminatory, or unethical content.

1.2. Prohibited Uses of AI

Partners may not use AI tools provided by LeadGeneratorX to:

  • Develop content that violates intellectual property rights or privacy laws.
  • Engage in illegal, fraudulent, or misleading activities.
  • Create automated systems for spamming or harassment.

1.3. Monitoring and Auditing

LeadGeneratorX reserves the right to monitor and audit the use of AI tools to ensure compliance with these Guidelines. Non-compliance may result in termination of access to AI tools and/or removal from the Program.


2. Data Protection

2.1. Data Privacy Standards

2.1.1. Compliance with Laws:
Partners must comply with all applicable data protection laws, including but not limited to:

  • General Data Protection Regulation (GDPR) if operating in the European Economic Area (EEA).
  • California Consumer Privacy Act (CCPA) if operating in the United States.
  • Privacy Act 1988 (Australia) if operating in Australia.

2.1.2. Data Collection and Use:

  • Collect personal data only with the individual’s explicit consent.
  • Use personal data solely for purposes explicitly disclosed to the data subject.

2.2. Data Security

2.2.1. Protection of Data:

  • Implement strong security measures to protect personal data, including encryption, secure storage, and access controls.
  • Regularly update and patch software to address vulnerabilities.

2.2.2. Reporting Data Breaches:

  • Notify LeadGeneratorX within 24 hours of discovering any data breach involving customer data related to the Program.
  • Cooperate fully with LeadGeneratorX to mitigate the breach and comply with notification requirements.

3. Compliance with Regulations

3.1. Marketing Compliance

3.1.1. Truth in Advertising:
Partners must adhere to all advertising regulations, ensuring that marketing claims are truthful, substantiated, and not misleading.
3.1.2. Opt-Out Requests:
Respect customer opt-out requests in email marketing and comply with anti-spam laws such as the CAN-SPAM Act (US) or the Spam Act 2003 (Australia).

3.2. Intellectual Property

3.2.1. Authorized Use Only:
Use LeadGeneratorX’s trademarks, logos, and promotional materials in accordance with the Program’s guidelines. Unauthorized use of third-party intellectual property is strictly prohibited.

3.3. Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF)

Partners must comply with all applicable AML and CTF laws. Suspicious activities must be reported to the relevant authorities and LeadGeneratorX.


4. Partner Responsibilities

4.1. Independent Responsibility

Partners are independently responsible for:

  • Compliance with local, national, and international laws.
  • Securing customer data collected through their activities.
  • Ensuring AI-generated content aligns with these Guidelines.

4.2. Training and Awareness

Partners are encouraged to:

  • Participate in training sessions provided by LeadGeneratorX on AI tools and compliance.
  • Stay updated on changes to data protection laws and AI ethics standards.

5. LeadGeneratorX Responsibilities

5.1. AI Tools and Updates

LeadGeneratorX will:

  • Provide Partners with AI tools that comply with current ethical and legal standards.
  • Regularly update AI tools to reflect advancements and regulatory changes.

5.2. Data Protection

LeadGeneratorX ensures that its systems comply with applicable data protection laws and employs robust security measures to protect Partner and customer data.


6. Enforcement and Penalties

6.1. Monitoring

LeadGeneratorX reserves the right to monitor Partner activities to ensure compliance with these Guidelines.

6.2. Breach of Guidelines

6.2.1. Penalties:
Non-compliance may result in:

  • Suspension or termination of participation in the Program.
  • Revocation of access to AI tools and resources.
  • Legal action, if necessary, to address violations.

6.2.2. Remedial Measures:
Partners found in breach may be required to take corrective actions, including updating practices, retraining staff, or submitting compliance documentation.


7. Updates to Guidelines

LeadGeneratorX may revise these Guidelines periodically. Partners will be notified of any updates, and continued participation in the Program constitutes acceptance of the revised Guidelines.
